Nothing contained in this document is document is to be construed as legal advice and the correctness thereof cannot be guaranteed. Should you accept the risks, NOW READ what follows:
1. PREAMBLE
1.1. The Donee is authorised by its Members to enter into agreements with private parties relating to the service of cultivating members’ Cannabis privately on behalf of its Members.
1.2. The Cannabis is cultivated for and on behalf of the Membership body and ownership remains at all times with the Collective Membership body.
1.3. The Donor is a Member of ‘High Street’ and therefore acts in the interest of Collective Membership body.
2. DONATION
2.1. The Donor donates to the Donee, as a donation:
2.1.1. The movable property as described in paragraph 4 to the Donee.
2.1.2. The donation is made with immediate effect upon the signing of this Deed of Donation by both parties.
2.1.3. By affixing his/her signature to this Deed of Donation, the Donor hereby cedes and transfers over to the Donee all rights, titles and interest of the Donor in the said property, for which the Donor receives no consideration in return.
2.1.4. It is expressly agreed that the Donor is under no legal obligation to donate the property, and the Donor herewith undertakes to give the property to the Donee, with the intention of enriching the Donee, for which the Donor receives no consideration in return.
3. TERMS AND CONDITIONS
3.1. It is expressly agreed that the Donor ceases to possess the property for him/herself and may then hold the property in the name of the Donee, which has no effect on the Donee’s new ownership of the property.
3.2. The Donee provides their written consent that the donated property may be retained by the Donor, with the intention of fulfilling the Independent Grower Agreement, which authorises the Donor to perform cultivation services on the donated property for and on behalf of the Donee’s Membership body.
3.3. It is expressly agreed that the Donee will be kept abreast of the exact location of their property and that ownership of the property remains with the Donee regardless of its location.
4. CONTENTS OF DONATION
4.1. The contents of the Donation are as follows:
4.1.1. The Donor hereby agrees to donate its entitlement to possess 100g of Cannabis per month to the Donee.
5. ACCEPTANCE
5.1. The Donee hereby gratefully accepts the donation aforesaid subject to the aforementioned conditions.
